The Regulations on the procedure for withdrawal from the list of candidates for deputies, changing the order of candidates for city council deputies, early termination of deputy’s powers and filling the vacant mandate of a deputy

General Provisions
The Regulations have been developed in accordance with the Constitution of the Kyrgyz Republic, the Constitutional Law of the Kyrgyz Republic “On elections of the President of the Kyrgyz Republic and Jogorku Kenesh Deputies of the Kyrgyz Republic”, the laws of the Kyrgyz Republic “On the status of Jogorku Kenesh Deputy of the Kyrgyz Republic”, “On the Regulations of the Jogorku Kenesh of the Kyrgyz Republic”, “On elections of local council deputies”, “On the status of a local council deputy”, “On local self-governance”, “On election commissions for conducting elections and referenda in the Kyrgyz Republic”.
The Regulations determines:
- Procedure for withdrawal from the list of candidates for deputies;
- Procedure for changing the order of candidates for city council deputies;
- Procedure for early termination of deputy’s powers;
- Procedure for filling the vacant mandate of a deputy.
If a candidate / deputy does not have the opportunity to personally submit an application, his/her authorized representative submits a notarized application of the candidate / deputy to the relevant election commission.
1. Procedure for withdrawal from the list of candidates for deputies
1. A candidate who is on the list of candidates nominated by a political party registered by the relevant election commission, after voting and before the distribution of deputy mandates, has the right to submit a written statement to the relevant election commission for withdrawal from the list of candidates.
2. A candidate for the Jogorku Kenesh deputy submits a written application for withdrawal from the list of candidates according to Form # 1, which must be notarized and submitted by the candidate personally in writing.
3. A candidate for the local council deputy submits a written application for withdrawal from the list of candidates according to Form # 1/1 (for city councils), Form # 1/2 (for village councils) personally in writing.
4. If a candidate does not have the opportunity to personally submit an application (Form No.1, Form No.1/1, Form No.1/2) on withdrawal from the list of candidates, the person responsible for the election of a political party authorized by the candidate shall submit a notarized application of the candidate for withdrawal from the list of candidates to the relevant election commission.
2. The order of changing the order in the lists of candidates for city council deputies

A candidate on the list of candidates, after voting and before the distribution of deputy mandates, submits an application as per Form # 2 (with the attached candidate's consent to change the order as per Form # 2/1), and applies to the relevant territorial election commission with a statement to change the order in the list of candidates with the consent of the supreme body and upon the proposal of the territorial body of a political party.
6. If the candidate does not have the opportunity to personally submit an application to change the order in the list of candidates, the authorized representative of the political party submits a notarized application and the consent of the candidates to change the order in the list of candidates to the relevant territorial election commission.
3. The procedure for early termination of the powers of a deputy
7. A Jogorku Kenesh deputy submits a statement on early termination of the deputy's powers as per Form # 3, which must be submitted personally in writing.
8. If the candidate does not have an opportunity to personally submit the application, the authorized person submits a notarized application of the deputy on early termination of powers to the Central Election Commission.
4. The procedure for filling the vacant mandate of a deputy
9. When a vacant mandate is formed, the next candidate on the registered list of candidates shall update and submit the following documents to the relevant election commission:
9.1. a completed special form with information about the candidate (biographical and other data);
9.2. certificate from the place of work;
9.3. copy of the passport;
9.4. certificate of the presence / absence of a criminal record.
10. When a vacant mandate is formed, the governing body of a political party within 3 days has the right to nominate another candidate (candidates) from the list without objection of the next candidate (candidates) as per Form # 4.
11. If a candidate does not have the opportunity to personally submit the application to the territorial election commission, the application must be notarized.
